TERMS OF PURCHASE & PRODUCT LICENCE Version: 2026-11-04-v1 · 4 November 2026
1. Seller, contact and scope
BARACHEVSKY Store is the public trading brand of Stan Barachevsky. The contracting seller's full legal name, registered business address, identification number and contact details are stated in the Seller details displayed with these terms. Those details must be completed before orders are accepted. Customer support, complaints and withdrawal notices: info@barachevsky.store or the Support form on this website. These terms cover digital downloads, downloadable software and individually described services. A product page's specific description and expressly agreed licence take priority over the general licence below where they differ. Mandatory consumer rights always take priority.
2. Products and compatibility
Read the product page before ordering: contents, formats, supported software and versions, system requirements, language, delivery method, licence scope and any access or service period. LUTs, PowerGrades and presets require appropriate source material and compatible software; results depend on footage, exposure, colour management and your adjustments. Examples illustrate a workflow, not a promise of identical results or income. Templates are editable starting points, not individual legal, tax or business advice; adapt them to your circumstances and jurisdiction. This does not excuse inaccurate descriptions, missing promised features or defective supply. Ask Support about any missing compatibility information before purchase.
3. Ordering, prices and payment
Review the selected products and email address and correct errors before submitting the order. Prices and the payable total are shown in EUR, including any taxes applicable to the sale; no physical shipping charge applies to downloads. A bank or payment provider may charge its own currency-conversion fee. Any accepted discount is shown before payment is authorised. Paid orders are processed through Stripe. You place a binding paid order using Stripe's final payment button; an order is accepted when payment is confirmed and the order confirmation is issued. A failed or cancelled payment is not a completed purchase. A free order requires no payment card. No recurring fee applies unless a product expressly states a recurring price, renewal terms and cancellation method before purchase; this checkout currently processes one-time orders.
4. Delivery and access
Downloads or private access links are made available after payment is confirmed, or after a free order is accepted. The confirmation is sent to the checkout email. If a payment method confirms later, delivery waits for that confirmation. Service orders provide the agreed next steps rather than implying that a consultation has already taken place. Contact Support promptly if an expected email or file does not arrive. A private download link normally expires after 30 days for security; this expiry does not shorten statutory rights or the permitted duration of an already supplied licence. Keep a backup of downloaded files and your order confirmation. Support can verify a valid purchase and assist with renewed access. Do not share your private link.
5. Digital content: immediate supply and withdrawal
An EU consumer normally has 14 days from conclusion of a distance contract to withdraw without giving a reason. For paid digital content supplied without a physical medium, that right is lost once supply starts only where the consumer has first expressly consented to supply during the withdrawal period, acknowledged the resulting loss of the withdrawal right, and received the required contract confirmation on a durable medium.
Our immediate-delivery checkout asks for that consent in a separate, unticked checkbox. The order confirmation records the request and acknowledgement. If you do not wish to consent to early supply, contact Support before ordering to discuss delivery after the withdrawal period.
Once these legal conditions are met and supply of the digital content has begun, the sale is final for change-of-mind purposes. We do not offer an additional voluntary right to return or exchange a correctly supplied, conforming digital product merely because it has been downloaded, used, is no longer needed, or you prefer a different creative result. A general acceptance of these terms alone does not remove your withdrawal right. This restriction does not affect rights concerning defects, non-delivery, an incorrect product, misleading descriptions, duplicate charges, unauthorised payments or any other mandatory remedy. It does not automatically apply to services or hosted digital services.
6. Services, mentoring, coaching and hosted access
The product page states the scope, duration and scheduling arrangements. Unless you expressly request an earlier start, performance of a consumer service is arranged after the 14-day withdrawal period. A separate optional checkout checkbox records an early-start request. If you validly withdraw after a requested early start, payment may be due for the proportion already performed, as permitted by law. The withdrawal right is lost only after full performance with the required prior consent and acknowledgement. An appointment booking alone does not remove it. A future hosted CRM or continuing digital service must state its access period, cancellation conditions, updates and any separate data-processing terms before sale; the download exception must not be treated as a blanket exception for hosted services. Cancellation or rescheduling conditions stated before booking apply only insofar as compatible with mandatory rights. If we cannot provide an agreed service, we will offer an agreed alternative or the refund required by law. Outcomes, awards, sales and earnings are not guaranteed.
7. How to withdraw or complain
Use the Support form on this website or email info@barachevsky.store with an unequivocal statement, your name, checkout email and sufficient information to identify the order. You need not give a reason or use a particular form. For a time-limited withdrawal right, sending the notice before the deadline is sufficient. We will acknowledge withdrawal notices by email. Receipt of a notice does not itself decide whether a withdrawal right exists or whether a particular refund is due.
Optional withdrawal form: To the seller identified in Seller details, email info@barachevsky.store: I hereby withdraw from my contract for the following product/service: [description]. Ordered on: [date]. Order reference: [reference]. Consumer name: [name]. Consumer address: [address]. Email: [email]. Date: [date]. Signature: [only when submitted on paper].
For a valid withdrawal, reimbursement is made without undue delay and within the applicable statutory period, normally 14 days after notice, using the original payment method unless another method is expressly agreed without extra cost. There are no return postage costs for an electronic download. Stop using and distributing content when a valid contract termination requires this; any refunded licence/access may be ended in accordance with law.
8. Defects and statutory remedies
We are responsible for the supply and conformity legally required of us. Report the problem, affected product, order reference and relevant software/version to Support; screenshots or error messages can help but do not replace or limit your rights. We confirm receipt and explain the outcome. Where legally required, we supply missing content or bring it into conformity free of charge, within a reasonable time and without significant inconvenience. A price reduction or termination/refund is available under the applicable statutory conditions. Under Czech consumer rules, defects in one-off digital supply may be asserted during two years after supply; for continuing supply the relevant rights apply during the agreed supply period, subject to mandatory rules. Necessary updates, including security updates, are provided for the period required by law; no commercial promise of unlimited new versions or lifetime support is made. Digital-content complaints are handled within the reasonable period required for the content and its purpose; service complaints are handled within the applicable statutory time limit. A download or no-voluntary-refund policy never removes these rights.
9. Standard product licence
Unless the product page expressly grants another licence, a lawfully supplied purchase or free download grants one individual or purchasing business a non-exclusive licence to use the supplied version for its own personal and commercial projects. Creative assets may be used in unlimited finished films, photographs, advertisements and other rendered client work without an additional per-project fee. You may supply the finished work to clients and publish it. Source assets must not be extractable or offered as a substitute for the original product.
You may adapt purchased templates for your own business and deliver completed documents to your clients; your professional advisers may review them for that purpose. Downloadable software is licensed to one user on up to two devices controlled by that user, with one simultaneous user, unless the product grants additional seats. CRM installations, team access, hosted services and custom work are limited to the users, installations and use cases expressly described in their offer. A download does not transfer copyright or grant a right to sell a competing product.
Do not resell, redistribute, sublicense, publish or share original files, editable source packs, installation packages, licence keys or private download links; upload them to asset libraries, public drives or marketplaces; make unlicensed copies for other people; or include them in another downloadable product. Do not remove rights notices or bypass access controls. Keep reasonable personal backups. Third-party components and open-source software remain subject to their stated licences. Nothing here excludes a transfer, backup, interoperability, reverse-engineering or other right which applicable mandatory law does not allow us to restrict. A material licence breach may lead to action against unauthorised use; we will not remove unrelated consumer rights or impose an arbitrary penalty. Where a licence is lawfully terminated, cease the unauthorised use and delete copies as required by law.
10. Responsibility, changes and disputes
Use tools with care and keep backups of source work. We do not accept responsibility for problems caused solely by undisclosed unsupported systems, unauthorised modifications or use contrary to clear instructions, to the extent permitted by law. No exclusion or limitation applies to fraud, intentional wrongdoing, gross negligence, injury, mandatory consumer remedies or other liability that cannot legally be limited. We do not make a blanket exclusion of all software or data-loss liability.
The version accepted for your order governs that order. Later website edits do not retroactively reduce purchased rights. These terms are governed by Czech law without depriving consumers of mandatory protection of the law of their habitual residence where applicable. Consumers retain the courts and remedies available under mandatory law; no mandatory private arbitration is imposed. After first attempting resolution with us, eligible consumers may seek alternative dispute resolution through the Czech Trade Inspection Authority (Česká obchodní inspekce): https://coi.gov.cz/mimosoudni-reseni-spotrebitelskych-sporu-adr/ . A Czech ADR application is normally due within one year of first asserting the claim with the trader. The former EU ODR platform has been discontinued and is not an available complaint channel.
